1. Introductory provisions
1.1. The ELAJEDIOVA online shop
- 1.1.1. The ELAJEDIOVA online shop at https://www.elajediova.com is operated by Eliška Kacvinský Judová, Company ID (IČO) 03554571, registered address Černomořská 645/6, 101 00 Prague 10 – Vršovice, Czech Republic, sole trader registered in the Trade Register, not a VAT payer (the “Seller”). Contact: e-mail elajediova@gmail.com, phone +420 775 363 559, bank account 123-3751360297/0100.
- 1.1.2. These terms govern the rights and obligations of the Seller and the Buyer arising from a purchase contract concluded through the Seller’s online shop.
1.2. Buyer
- 1.2.1. A Buyer – consumer – is any person who concludes a contract with the Seller outside their business or profession (the “Buyer”).
- 1.2.2. Matters not covered by these terms are governed by the Czech Civil Code (Act No. 89/2012 Coll.) and the Consumer Protection Act (Act No. 634/1992 Coll.), as amended.
- 1.2.3. A Buyer – entrepreneur – acts within their business when concluding the contract; consumer protection provisions do not apply to them.
1.3. Terms and conditions
- 1.3.1. These terms form an integral part of the purchase contract. Different arrangements in the contract take precedence.
- 1.3.2. By sending an order the Buyer confirms they have read and agree to these terms.
2. Order, contract, shipping and payment
2.1. Offer of goods
- 2.1.1. Goods shown in the shop are an informative offer, not a proposal to conclude a contract under Section 1732(2) of the Civil Code. Prices are final; the Seller is not a VAT payer.
- 2.1.2. Riso prints and hand-sewn products may differ slightly from the photos in shade and colour intensity; this is not a defect.
2.2. Order and conclusion of the contract
- 2.2.1. The Buyer chooses the goods and shipping method and pays for the order. By sending and paying for the order the Buyer makes a binding proposal to conclude a purchase contract.
- 2.2.2. The contract is concluded when the order confirmation is delivered to the Buyer’s e-mail. The Seller may decline an order, in particular when the goods are sold out or the price was obviously wrong; the amount paid is then refunded without undue delay.
- 2.2.3. Costs of distance communication (internet, phone) are borne by the Buyer and are not higher than usual.
2.3. Shipping
- 2.3.1. The Seller delivers to the Czech Republic, Slovakia and the other European Union countries listed at checkout: to a Packeta (Zásilkovna) pickup point (in the Czech Republic and Slovakia), by GLS courier to the Buyer’s address, or the Buyer can pick the goods up in Prague (Černomořská 6, Prague 10) by arrangement. The shipping price to the chosen country is shown at checkout before the order is sent.
- 2.3.2. The Seller informs the Buyer by e-mail when the goods are shipped or ready for pickup.
- 2.3.3. If the goods have to be delivered again or in a different way for reasons on the Buyer’s side, the Buyer pays the related costs.
2.4. Payment
- 2.4.1. Orders are paid in advance by card, Apple Pay or Google Pay via the Stripe payment gateway. Card details are processed by Stripe only; the Seller has no access to them.
- 2.4.2. The price is paid at the moment the payment succeeds. The Seller sends the Buyer an invoice (proof of purchase) by e-mail.
3. Delivery and receipt
- 3.1. The Seller ships the goods as soon as possible after payment unless stated otherwise for the goods. If the goods cannot be shipped within a reasonable time, the Seller informs the Buyer without delay.
- 3.2. Ownership and the risk of damage pass to the Buyer when the goods are received.
- 3.3. On receipt the Buyer checks that the packaging is intact. If the parcel is obviously damaged, the Buyer is advised not to accept it and to record the damage with the carrier.
4. Withdrawal from the contract
4.1. Withdrawal by the Buyer
- 4.1.1. Under Section 1829 of the Civil Code a consumer may withdraw from the contract without giving a reason within 14 days of receiving the goods. The deadline is met if the notice of withdrawal is sent within this period.
- 4.1.2. The Buyer notifies the withdrawal by e-mail to elajediova@gmail.com or by letter to the registered address, optionally using the model form at the end of these terms.
- 4.1.3. The Buyer returns the goods without undue delay, no later than 14 days after withdrawing, to Černomořská 6, 101 00 Prague 10, Czech Republic. The Buyer bears the cost of returning the goods.
- 4.1.4. The Seller refunds all payments received, including delivery costs (at the cheapest offered rate), within 14 days of the withdrawal, in the same way they were received (to the card). The Seller is not obliged to refund before receiving the goods or proof that they were sent.
- 4.1.5. The Buyer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning; the Seller may set this off against the refund.
- 4.1.6. Withdrawal is not possible in the cases listed in Section 1837 of the Civil Code, in particular for goods customised to the Buyer’s wishes.
4.2. Withdrawal by the Seller
- 4.2.1. The Seller may withdraw if the goods cannot be delivered (e.g. sold out) or were offered at an obviously wrong price. The Seller informs the Buyer by e-mail without delay and refunds the amount paid within 14 days.
5. Defective goods (claims)
- 5.1. Rights from defective performance are governed in particular by Sections 2099–2117 and 2161–2174 of the Civil Code. A consumer may claim a defect in consumer goods within 24 months of receipt.
- 5.2. The Seller is responsible for the goods being free of defects on receipt, in particular having the described properties, being fit for their usual purpose and matching the contract in quality and quantity. A defect appearing within one year of receipt is presumed to have existed on receipt.
- 5.3. The Buyer makes a claim by e-mail to elajediova@gmail.com with a description of the defect and the order number, and sends or hands over the goods to Černomořská 6, 101 00 Prague 10.
- 5.4. The Seller confirms receipt of the claim and settles it without undue delay, no later than 30 days after it was made, unless a longer period is agreed. If the claim is justified, the Buyer is entitled to reimbursement of reasonable costs.
- 5.5. The Buyer has no rights from defective performance if they caused the defect or knew about it before receipt.
6. Complaints and out-of-court dispute resolution
- 6.1. Complaints can be sent to elajediova@gmail.com; the Seller replies by e-mail.
- 6.2. The body competent for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce), ADR department, Gorazdova 1969/24, 120 00 Prague 2, https://adr.coi.cz. Consumers from Slovakia may also contact the Slovak Trade Inspection (Slovenská obchodná inšpekcia), consumers from another EU member state the European Consumer Centre Czech Republic (https://www.evropskyspotrebitel.cz).
- 6.3. The Seller is supervised by the Czech Trade Inspection Authority, the competent trade licensing office and, for personal data, the Office for Personal Data Protection.
7. Personal data
- 7.1. The Seller processes personal data according to the Privacy Policy at https://www.elajediova.com/en/privacy. The shop uses no advertising or analytics cookies.
8. Final provisions
- 8.1. The contract is concluded in Czech and governed by Czech law, without prejudice to the consumer’s rights under the mandatory laws of their country of habitual residence. Concluded contracts are archived electronically and are not accessible to third parties.
- 8.2. If any provision is invalid, the other provisions remain valid.
- 8.3. The Seller may change these terms; contracts concluded before a change are governed by the version in force when they were concluded.
- 8.4. This version takes effect on the day it is published at www.elajediova.com (revision of 23. 10. 2026).
